K-12Buddy Terms of Service

1. Acceptance of Terms

By accessing or using K-12Buddy, including its website, applications, AI-powered educational features, parent dashboards, tutoring tools, and related services (collectively, the "Service"), you agree to these Terms.

If you are a parent or legal guardian authorizing a child to use K-12Buddy, you agree to these Terms on your own behalf and, where legally permitted, on behalf of the child.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

K-12Buddy provides technology-assisted educational services for K-12 students, parents, guardians, and educators.

Features may include:

• AI-powered educational assistance
• Homework and study support
• Interactive learning activities
• Quizzes and assessments
• Progress tracking
• Parent or guardian dashboards
• Educational reports
• Tutoring or communication features
• Other educational tools introduced from time to time

Features may differ by subscription, location, age, platform, or account type.

3. Educational and AI Disclaimer

3.1 Supplemental Study Aid

K-12Buddy is a study aid. It is intended to supplement education, not replace teachers, schools, qualified educational professionals, parental supervision, or a student's own schoolwork.

K-12Buddy should not be relied upon as a substitute for:

• Classroom instruction
• Professional educational assessment
• Professional educational, tutoring, or special-education services
• Medical services
• Mental-health services
• Psychological evaluation
• Emergency assistance
• Professional legal or financial advice

Students should use K-12Buddy to improve understanding and learning rather than to misrepresent AI-generated work as their own.

3.2 Accuracy of AI-Generated Content

Artificial intelligence can generate incomplete, inaccurate, outdated, or inappropriate responses. Explanations, answers, worked solutions, quizzes, and study materials produced by K-12Buddy may contain errors.

AI-generated content must be independently verified with a teacher, a qualified educator, or authoritative course materials before it is relied upon for schoolwork, assignments, assessments, or any other purpose.

Users should independently verify important information.

3.3 No Guarantee of Academic Outcomes

K-12Buddy does not guarantee academic success, improved grades, higher test or exam scores, class placement, admission outcomes, or the meeting of any specific educational standard, curriculum requirement, or learning objective.

No statement made by Cien Rios LLC, on the K-12Buddy website, in any application store listing, or in any marketing or support material should be understood as a promise, warranty, or prediction of any particular academic result. Individual results depend on factors outside our control, including a student's effort, prior knowledge, instruction, and circumstances.

Continued access to the Service is not conditioned on, and is not offered in exchange for, any academic outcome.

4. User Accounts

4.1 Account Creation

Certain features require an account.

Users agree to:

• Provide accurate information
• Maintain current account information
• Protect login credentials
• Prevent unauthorized access
• Promptly notify us of suspected unauthorized use

You are responsible for activity occurring through your account to the extent permitted by law.

4.2 Children and Age Requirements

Children under 13 may use K-12Buddy only through a process that complies with applicable parental-consent requirements.

Where required by COPPA, Cien Rios LLC will obtain verifiable parental consent before collecting personal information from a child under 13.

Parents and guardians are responsible for appropriately supervising their child's use of the Service.

4.3 School Accounts

Schools or educational institutions that provide access to K-12Buddy are responsible for obtaining permissions or consents required for their students' use of the Service.

Additional agreements may apply to institutional accounts.

5. Acceptable Use

Users may not:

• Use K-12Buddy for unlawful activities
• Submit harmful, abusive, threatening, or illegal material
• Attempt unauthorized access to accounts, systems, or networks
• Circumvent security or access controls
• Disrupt or overload the Service
• Introduce malware or malicious code
• Scrape or systematically extract Service content except as expressly permitted
• Reverse engineer protected portions of the Service except where applicable law expressly permits it
• Impersonate another person or organization
• Share account credentials without authorization
• Use K-12Buddy to facilitate academic dishonesty
• Exploit, harm, groom, threaten, or endanger a child
• Use the Service in a manner that violates another person's intellectual-property or privacy rights

We may restrict or suspend access when reasonably necessary to protect users, children, our systems, or Cien Rios LLC.

6. Academic Integrity

K-12Buddy is designed to help students understand concepts and develop skills.

Students remain responsible for following the academic-integrity requirements of their school, teacher, educational institution, or testing organization.

K-12Buddy should not be used to:

• Cheat on examinations
• Circumvent testing restrictions
• Submit AI-generated work as original work when prohibited
• Obtain unauthorized answers to graded assessments

7. Subscriptions, Payments, and Billing

K-12Buddy may offer free and paid plans.

Prices, features, billing intervals, trial periods, and renewal terms will be displayed before purchase.

Depending on the platform, payments may be processed by an authorized third-party payment processor or application marketplace.

By purchasing a recurring subscription, you authorize applicable recurring charges until the subscription is cancelled.

Users must cancel subscriptions through the method identified at purchase or in their account or applicable platform settings.

8. Cancellation and Refunds

Subscription cancellation stops future renewal but does not necessarily provide a refund for an already completed billing period.

Any refund guarantee specifically displayed at the time of purchase will apply according to its stated conditions.

Purchases processed through Apple, Google, or another marketplace may also be subject to that marketplace's payment, cancellation, and refund policies.

Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

9. Privacy and Children's Data

Use of K-12Buddy is governed by the K-12Buddy Privacy Policy.

Cien Rios LLC takes additional precautions regarding children's information and seeks to comply with applicable children's privacy and student-data requirements.

Parents and guardians may contact privacy@cienrios.com regarding applicable privacy rights.

10. Intellectual Property

Except for user content and third-party materials, K-12Buddy and its software, designs, interfaces, trademarks, graphics, features, educational systems, and original content are owned by or licensed to Cien Rios LLC and are protected by applicable intellectual-property laws.

These Terms grant users a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended educational purposes.

No ownership interest in K-12Buddy or Cien Rios LLC intellectual property is transferred to users.

11. User Content

Users may submit questions, assignments, documents, answers, educational materials, prompts, or other content ("User Content").

Users retain ownership of their User Content to the extent they hold ownership rights in that content.

Users grant Cien Rios LLC a limited license to host, process, reproduce, transmit, and otherwise use User Content as reasonably necessary to:

• Provide the Service
• Generate requested educational output
• Maintain account functionality
• Protect the Service
• Comply with law

We will handle personal information contained in User Content according to our Privacy Policy.

12. Third-Party Services

K-12Buddy may depend on or integrate with third-party technology providers.

Those providers may have their own terms and privacy practices.

Cien Rios LLC is not responsible for third-party services outside our reasonable control, except to the extent responsibility cannot be excluded under applicable law.

13. Availability and Changes

We continuously develop K-12Buddy and may add, modify, replace, or discontinue features.

We do not guarantee that every feature will always be available or operate without interruption.

Where required by law, we will provide appropriate notice of material changes affecting paid services.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, K-12BUDDY AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."

CIEN RIOS LLC DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

WE DO NOT WARRANT THAT AI-GENERATED OUTPUT WILL ALWAYS BE ACCURATE, COMPLETE, APPROPRIATE, OR ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CIEN RIOS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE SERVICE.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

16. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Cien Rios LLC and its officers, members, employees, and agents from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the Service, violation of these Terms, or infringement of another person's rights.

This provision does not apply to the extent prohibited by applicable law.

17. Suspension and Termination

Users may stop using K-12Buddy at any time.

Cien Rios LLC may suspend or terminate access when reasonably necessary because of:

• Material violations of these Terms
• Fraud
• Security threats
• Illegal activity
• Harm to other users
• Child-safety concerns
• Abuse of the Service
• Legal or regulatory requirements

Where appropriate and legally required, we will provide notice.

18. Changes to These Terms

We may update these Terms as K-12Buddy evolves.

For material changes, we may provide notice through the Service, by email, or through another reasonable method.

Where applicable law requires affirmative or parental consent to a change, we will seek such consent.

19. Governing Law

These Terms are governed by applicable federal law and the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Any mandatory rights available to consumers under applicable law remain unaffected.

20. Educational Institutions

Schools and educational institutions using K-12Buddy are responsible for:

• Obtaining permissions and consents required by applicable law
• Appropriately supervising student use
• Maintaining authorized account access
• Complying with applicable education and student-privacy requirements
• Using K-12Buddy consistently with institutional policies

Separate school, district, data-processing, or student-privacy agreements may supplement these Terms.
